2. Scope of Application
These General Terms and Conditions of Sale apply, without limitation or reservation, to all sales concluded by the company Nove s.r.l.s., operating under the brand name C.9.3 ("the Seller") to consumers and non-professional purchasers ("the Customers" or "the Customer"), who wish to purchase products offered for sale by the Seller ("the Products") on the website https://c93.it/
These General Terms and Conditions of Sale have been drawn up in the Italian language and will be translated into the languages of the country concerned. In case of disagreement or discrepancy between the Italian version and the version in other languages, the Italian terms and conditions shall prevail.
These General Terms and Conditions of Sale specify the conditions of order, payment, delivery and management of any returns of Products ordered by Customers. These General Terms and Conditions of Sale may be supplemented by special conditions, set out on the Site, prior to any transaction with the Customer.
They are accessible at any time on the website https://c93.it/ and shall prevail, where appropriate, over any other version or any contradictory document.
C.9.3 may update these General Terms and Conditions of Sale at any time. The version applicable to the Customer's purchase is the one in force on the Website on the date of the order.
By placing an Order for a Product on the Site, the Customer declares full acceptance of the General Terms and Conditions of Sale.

3. Products offered for sale
The Products offered for sale by C.9.3 are those described on the Site on the day of consultation by the Customer, while stocks last.
The Seller cannot be held liable for any errors in updating available stocks nor, consequently, can it be held liable for the cancellation of an Order for a Product due to unavailability of stocks.
In the event that a Product becomes unavailable after the Customer has placed an Order, C.9.3 will inform the Customer by e-mail as soon as possible.
The essential characteristics of the Product(s), in particular the specifications, photographs and dimensions of the Product(s), are presented on the website https://c93.it/ . Every effort has been made to ensure that the colours of the Products displayed on the Web Site are true to the original products; however, variations may occur. C.9.3 cannot be held liable for any errors or inaccuracies in the photographs of the Products that appear on the Website.
The Customer declares that he/she has full legal capacity to enter into contracts and purchase the Product(s) offered on the website https://c93.it/ . The choice and purchase of a Product is the sole responsibility of the Customer.
"C.9.3" Products are reserved exclusively for direct sale to customers, natural persons or non-professional legal entities, referred to as "final customers". The Customer undertakes to act as an end customer and to refrain from purchasing the Products in order to resell them in the context of a commercial activity.

4. Orders
Placing an Order:
By placing an Order on the Website, the Customer declares that he/she fully accepts the General Terms and Conditions of Sale, the prices and the Products available for sale on the Website.
Order procedure:
Any Order placed on the Website must comply with the procedure set out in C.9.3, which includes the following successive steps leading to the validation of the Order.
Choice of Product:
The Customer may select one or more Products in the desired number, and such selection will be automatically added to the Shopping Cart ("the Cart").
Checking the content:
By clicking on the Shopping Cart, the Customer can view the list of selected Products. As long as the Order has not been validated, the Customer can return to the Shopping Cart and modify it if necessary.
Identification:
The Customer must create an account by completing the identification form provided and entering the required information. Il Cliente si impegna a fornire informazioni accurate. The Customer who already has an account must identify himself by entering the username and password he entered when creating the account.
Verification of the order:
It is the Customer's responsibility to verify the accuracy of the Order, the total price and their personal details and to delete or correct any errors immediately before final validation.
Order validation:
The Customer must confirm the delivery and payment terms. The Customer must also confirm acceptance of these General Terms and Conditions of Sale by ticking the corresponding box.
Order confirmation:
Once full payment has been made, the Customer shall receive a confirmation e-mail at the e-mail address indicated at the time of the Order.
The Order is then registered and processed by C.9.3, and it is at this time that the availability of the ordered Product(s) is confirmed.
Confirmation of dispatch: The Customer shall receive an e-mail confirming that the Order has been dispatched. The sale shall be considered final only on the date on which this e-mail is sent.
Each Order placed and validated by the Customer and confirmed by the Seller, under the conditions and in the manner described above, on the website https://c93.it/, constitutes the formation of a contract concluded at a distance between the Customer and the Seller.
The Vendor reserves the right to cancel or reject any Order from a Customer with whom a dispute exists concerning the payment of a previous Order.
Order tracking:
The Customer will be able to track the progress of his Order on the Website in his customer area. The Customer will also receive information by e-mail on the follow-up and processing of his Order. If the Customer wishes to track his/her Order, he/she may contact the chosen courier directly and follow the delivery of his/her parcel.

5. Prices
Product prices are quoted in the currency of the customer's shipping country.
All deliveries within Europe are not subject to import duties and taxes. All orders shipped to the United States, Canada and New Zealand are subject to payment of any import duties and taxes.
For deliveries to the rest of the world where customs duties are applicable, the customer may choose to pay duties at checkout or upon receipt of the order.
The Seller reserves the right to change prices at any time.
Prices do not include processing, shipping, transport and delivery costs, which are invoiced additionally, under the conditions indicated on the website https://c93.it/ and calculated before sending the Order.
If the Customer requests a faster or more expensive method of shipment than standard shipment, the additional delivery costs, as they result at the time of validation of the Order by the Customer, shall be borne by and under the sole responsibility of the Customer.
All Orders are payable in the currency of the Customer's country of dispatch and must be paid in full immediately after the Order is placed.
The payment due by the Customer corresponds to the total amount of the purchase, including any charges.

6. Terms of Payment
C.9.3 accepts different payment methods in different countries. In all countries C.9.3 accepts credit cards, but in many countries PayPal and country-specific payment methods are also accepted. At the checkout, the customer can see which payment methods are offered in his or her country.
The Customer expressly acknowledges that, by communicating his credit card number to the Seller, he authorises the latter to debit his account up to the amount of the total purchase price. Otherwise, a notice of cancellation of the order for non-payment shall be sent to the Customer to the e-mail address previously provided by the Customer.
The price payable by the Customer is the amount indicated on the order summary page.
The amount charged shall correspond to the Products actually delivered and the costs thereof.
The charge will be made when the Order is sent.
If a Product becomes unavailable between charging and delivery, a refund for the unavailable Product will be made as soon as possible.

7. Deliveries
Preparation and shipping costs depend on the country of delivery and the total amount of the Order. These costs are detailed on the invoice.
C.9.3 shall not be liable for any actions and/or charges and/or taxes (which shall be borne by the Customer) and/or for any delays due to customs services over which it has no control.
For all Products, the Order shall be prepared for dispatch at C.9.3's warehouse within a maximum period of three (3) working days from the day following the validation of the Order. Orders placed on the website https://c93.it/ on a Friday, Saturday or Sunday will be processed on the following Monday. Orders placed on a public holiday other than Friday, Saturday or Sunday will be processed on the next working day.
During periods of private sales, sales or archive sales, the shipping period can be extended by a maximum of 15 working days. It can also be extended to the day after a new collection goes online or during the Christmas shopping period between 23 November and 31 December.
If the Product(s) ordered have not been delivered within 30 working days from the indicative delivery date, for any reason other than force majeure or the Customer's fault, the sale may be cancelled at the Customer's written request the sums paid by the Customer shall then be returned within 14 days from the date of termination of the contract at the latest, to the exclusion of any compensation or damages.
In any event, the Seller shall not be liable for any damaging consequences resulting from a delay in delivery; only a refund of the Product by C.9.3 is possible, to the exclusion of any other form of compensation.
In the event of non-conformity of the delivered Product, the Seller undertakes to remedy the situation or to reimburse the Customer, as indicated in the article "Seller's Liability - Guarantees".
The Vendor bears the risks of transport and must reimburse the Customer for any damage caused during transport.
Upon receipt of the Order, the Customer must check the condition of the packaging and the conformity of the Product(s) delivered and, if applicable, note any reservations on the carrier's delivery note. This verification shall be deemed to have been carried out when the Customer, or a person of his choice, has signed the delivery note. No claim shall be accepted concerning the condition of the package(s) delivered.
In the event of absence, wrong address or rejection of the parcel by the addressee, making it impossible to deliver the Order to the addressee in good time, C.9.3 cannot be held responsible for the final quality of the delivery. In the absence of the addressee, subject to the carrier's delivery conditions, the Product(s) may be resubmitted and/or deposited at a sorting point and/or returned to C.9.3 .
If delivery is impossible, no reshipment will be made and the Customer will be reimbursed within 14 days after receipt of the Order by C.9.3 .
Deliveries are made through the services of:
DHL for national and international deliveries (standard and express).
Any complaints regarding the delivery of the Product(s) must be made within 14 working days of receipt of the Product(s). The Customer must contact customer service by e-mail at info@c93.it .

8. Right of Withdrawal
In accordance with current legal provisions, the Customer has a period of 14 days from receipt of the Product(s) to inform the customer service department that he/she wishes to return the Product(s) without having to justify the reasons or pay a penalty.
The customer must fill in the online return form or contact customer service by e-mail at info@c93.it to inform C.9.3 of its decision to exercise the right of withdrawal.
Products may be returned within 14 days after delivery. Products must be returned in their original condition, with the original labels attached and all packaging. Worn, used or damaged products will not be accepted. If these conditions are not met, C.9.3 reserves the right to refuse the return and refund. In such circumstances, the Product will be returned to the customer.
The costs and risks associated with returning the Product(s) shall be borne by the sender. The Seller shall not be liable for any loss, theft or damage to the package.
All packages must be traceable and their tracking number must be communicated to C.9.3. It is the sole responsibility of the Customer to keep proof of the return of a Product.
The right of withdrawal cannot be exercised in respect of the following Products, which cannot be returned: socks.
Sale items are non-refundable. They can only be exchanged for a different size or an e-shop credit.
The refund will be made within 14 days of receipt of the returned Product(s). The refund of the returned Product(s) will be made by the Seller using the original payment method used by the Customer for the initial transaction, unless the Parties agree on a different method. Refunds will only be made if the Seller has been able to recover the Product(s) that were the subject of the return and claim.
If payment was made by bank card or if the card has expired, refunds may only be made by bank transfer. In such circumstances, the Customer must provide the Seller with the 'IBAN' (bank details) so that the refund can be processed.
Any order paid for with a gift card, e-gift card or shop credit will automatically be refunded as shop credit.

9. Seller's Liability - Warranties
Products sold on the website https://c93.it/ comply with the regulations in force in Italy.
Products supplied by the Seller automatically, without additional payment and independently of the right of withdrawal, benefit from the following legal provisions:
the legal guarantee of conformity for Products apparently defective, flawed or damaged or not corresponding to the order; and the guarantee against hidden defects resulting from a defect in material, design or manufacture of the Products delivered, making them unsuitable for use, according to the terms and conditions set out below.
In order to exercise his rights, the Customer must inform the Seller in writing of the non-conformity of the Product(s) within a maximum period of 14 days after delivery of the Product(s) or of the discovery of hidden defects within the aforementioned period, and must return the defective Product(s) in the state in which it was received with all its elements (accessories, packaging, instructions, etc.).
The Vendor shall refund, replace or have repaired the Product(s) or parts under warranty that are deemed non-conforming or defective.
If the Product is replaced, the Seller shall bear the cost of return.
Shipping costs shall be reimbursed on the basis of the invoiced price, and return costs shall be reimbursed upon presentation of supporting documents.
The Seller cannot be held liable in the following circumstances
non-compliance with the legislation of the country to which the Products are delivered, which the Customer must verify; in the event of misuse, use for professional purposes, negligence or lack of maintenance by the Customer, or in the event of normal wear and tear of the Product, accident or force majeure.
In any event, the Seller's warranty is limited to the replacement or refund of non-conforming or defective Products.
The Seller's liability in respect of any Product purchased on the Website is strictly limited to the purchase price of the latter.
The documents, descriptions and information relating to the Products appearing on the Website are not covered by any warranty, express or implied, except for those warranties provided by law.
The Customer acknowledges that it is his/her responsibility to install appropriate anti-virus and security software on his/her computer and any other device to protect it from any bugs, viruses or other harmful computer programs. The Customer assumes all risks associated with any content downloaded or otherwise obtained through the use of the Website and agrees to be solely responsible for any damage.

10. Personal data
Pursuant to the rules contained in Regulation (EU) 2016/679 of 27 April 2016 ("GDPR"), Legislative Decree No. 196/2003 as amended and supplemented by Legislative Decree No. 101/2018 and the provisions laid down by the Italian Supervisory Authority, personal data requested from the Customer, are necessary for the processing of its Orders and the preparation of invoices. Such data may be communicated to any partners of the Seller in charge of the execution, processing, management and payment of the Orders. The processing of information communicated through the website https://c93.it/ meets the legal requirements for the protection of personal data, and the computer system used guarantees optimal protection of such data.
At any time, the Customer has the right to permanent access, modification, rectification, opposition, portability and restriction of the processing of information concerning him/her. To exercise this right, the Customer may make a request to the customer service by e-mail at info@c93.it
With the customer's consent, personal information about the customer may be used by C.9.3 and/or its partners for commercial purposes, such as sending newsletters or other solicitations.

11. Intellectual Property

12. Force majeure
The Parties cannot be held responsible if the failure or delayed fulfillment of any of the obligations described herein results from a case of force majeure pursuant to Article 1467 of the Italian Civil Code

13. Disputes
These General Conditions of Sale have been drawn up in Italian and will be translated into all the languages of the countries to which they belong. In case of disagreement or discrepancy between the Italian version and that of other languages, the Italian terms and conditions will prevail.
All disputes that may arise in relation to sales transactions concluded in application of these General Conditions of Sale, relating to their validity, interpretation, execution, resolution, consequences and results, and which cannot be resolved between the Seller and the Customer, will be submitted to the competent courts according to the conditions of common law.
In the event of a dispute, please note that the European Commission has established the ODR platform for the out-of-court resolution of disputes relating to contractual obligations arising from online sales or service contracts between a consumer and a professional respectively resident and established in the European Union.
